TERMS AND CONDITIONS OF SALE

1. NOTICE TO ALL LIVE EBAY BIDDERS: Our live auction is held at a location away from our business offices, each item must be packed and transported to the live auction site, and therefore, additional photo requests and condition reports cannot be given once items are packed prior to the auction. Please request your additional information in a timely manner. We will do our best to answer your questions. We make every attempt to list any condition beyond normal wear and tear as appropriate for the item and its age. Each lot is photographed in detail to help the potential buyer view any condition problems. Please review all of the information and photographs before placing your bid. Any request made after 5:00 pm on Friday may not be answered due to time and location constraints. Items purchased by Internet or Absentee Bidders will be shipped by Navis Pack & Ship Center, Oklahoma City. Since we are not shippers, we feel for your protection that packing should be handled by the professionals.
2. It is the buyer?s responsibility to arrange for and pay for shipping and insurance. Items MUST BE PAID FOR before shipping can be arranged. ALL items sold to Live eBay, absentee, and telephone bids that require shipping will be shipped by Navis Pack & Ship Center, Oklahoma City, Oklahoma. Any request for shipping quotes prior to the auction will be forward to Navis. The shipper has been provided an auction catalog and will provide you with shipping quotes. Please contact J. D. As stated all buyers will be invoiced within 72 hours after the close of the auction for the item(s) won. The buyer will be invoiced for shipping separately by Navis Pack & Ship NOT by Livingston?s Auction. Remember unless prior arrangements have been made with Livingston?s. A storage fee of $8.00 per item per day will be charged on all items not removed from the auction facility within 14 days from the date of sale. No Exceptions. Livingston & Associates Inc. is in no way responsible for the acts or omissions of independent contractors, packers, or carriers of purchased merchandise and will bear no liability for any loss or damage to such items. The cost of shipping shall be paid by the Buyer including all packaging expenses, including labor, materials and postage and carrier fees and all insurance charges. Shipping costs will not be refunded under any circumstances.
3. Livingston & Associates Inc. dba Livingston?s Auction has endeavored to accurately describe all of the items being auctioned. However, all property is sold ?as is?. Neither the auctioneer, auction staff, nor any consignor makes any warranties or representations of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty of descriptions of genuineness, authorship, attribution, provenance, period, culture source, origin or condition of the property, and no statement, oral or written, made at the sale or in the catalogue, bill of sale or invoice or elsewhere shall be deemed such a warranty or representation or an assumption of liability. All perspective buyers should personally inspect or have their agent inspect property before bidding. In no event will our liability to purchaser exceed the purchase price actually paid. All sales are final. No returns or refunds.
4. The highest bidder for each lot shall be the buyer. If any dispute arises as to the bidding or between two (2) bidders, the auctioneer has the final discretion to determine the successful bidder. The Auctioneer shall at his discretion decide to re-open the bidding or not. By bidding at this auction whether present, in person, or by written bid, telephone or live eBay bid Title to all items is transferred to the winning bidder once the Auctioneer says ?SOLD? and the winning buyer shall assume full responsibility for the lot purchased once the title has passed.
5. Arrangements for Telephone Bids and written Absentee bids must be made 24 hours prior to the start of the auction. Please call (405) 858-1914 or fax us at 405-605-6132 to place your absentee bid. The completed form with your signature is required before that bid can be entered into our computer system. We must have a Credit Card on file to accept absentee or telephone bids even if you select payment by check. Arrangements for payment will then be made after the auction.
6. Livingston?s Auction accepts absentee bids including written left bids, telephone bids, and live auction internet bids. Although our absentee bidding system is 100% honest, it is not foolproof. Livingston?s Auction is not responsible for failing to execute any absentee bid or internet bid. All absentee bids will be executed by a staff member competitively during the sale. All items will be purchased for the lowest price possible regardless of the amount of the absentee bid. In the event of tie bids between absentee bidders or Live eBay bidders and those in attendance, preference will be given to the attending bidder. Where two absentee bidders bid the same amount the first received will be honored. Should there be a significant change in the condition of the item such as damage or discovery of a condition problem that a representative of Livingston?s Auction deems in the best interest of the absentee bidder that the bidder would change the bid the bid will NOT be executed.
7. BUYERS PREMIUM A buyer?s premium of 12% of the successful bid price will be added to the total purchase price of all properties as part of the total purchase price on any lot sold through an absentee, telephone, or live eBay bid. This includes any bid left at the auction by a buyer who does not wish to remain at the auction to bid in person.
8. Floor Bidders: All items must be paid for in full before removal from the auction site.
Absentee & Live eBay Bidders: The successful buyer will be notified by Livingston?s Auction within 72 hours after the auction is complete. Payment MUST be made within 10 days from the date of the auction. All Shipping will be invoiced separately. Any item left longer than 14 days after the auction will be charged a storage fee of $8.00 per item per day. This charge will be strictly enforced. Accounts not settled within 30 days of the sale will be subject to forfeiture of all deposits and loss of title to the property.
9. Pre-sale estimates are intended as guides and may not be reflective of actual gavel price. Some of the items in this auction are subject to a reserve. The reserve is a confidential minimum price agreed upon by the consignor and Livingston?s Estate Services/Auction. Absentee bidders should call or email for an updated condition report. This report supersedes the catalog description. We can answer questions until 24 hours before the start of the auction. Please email all questions early, as we will not be able to answer any emails on auction day. We encourage all patrons to take advantage of the preview hours scheduled for the auction for personal inspection of any item they wish to bid on.
10. The auctioneer at her discretion may reject any bid not commensurate with the value of the article offered. We reserve the right to reject any bid or withdraw any lot from the sale.
11. We accept payment for all sales by cash, Money Order, Visa, Master Card, Discover, Pay Pal, and business or personal check (with valid ID).
12. Buyers are required to pay local state and local sales tax unless exempted by law. IF EXEMPT, buyers must file a tax exemption form with Livingston & Associates Inc. before any exemption can be made. Oklahoma residents will be charged 8.375% or prevailing Tax rate, unless exempt.
13. Bidding on any item indicates the bidder?s acceptance of the terms and conditions of Livingston?s Estate Services/Auction as stated either in writing or announcement at the time of sale, whether bidding in person, through a representative, by phone, by Internet, or other absentee bid.
